电子商务中的商标侵权研究

摘要：网络电子交易平台上出现的侵权问题，是伴随着电子商务的发展而应运而生的众多问题之一，而又以知识产权领域的侵权行为最为突出。以传统商标侵权理论为切入点，结合传统商标法的一般失灵，互联网环境下的商标使用行为，探讨互联网环境下商标侵权行为，对网络商标权的保护进行创新，分析网络坏境下商标保护新现象和类型，使其适应互联网环境下商标权保护的要求。

Abstract： Infringement appearing on the web-based electronic trading platform is one of the many problems which have emerged with the envelopment of e-commerce， and among which the most prominent is the field of intellectual property infringement. Because of the characteristics of the virtual， super-regional， technical diversity， the traditional trademark protection encountered unprecedented challenges. Analysis traditional trademark infringement theory as a starting point， combining with the use of trademarks environment， explore the Internet environment and the nature of trademark infringement existence with the general failure of traditional trademark law for the
