【摘要】本文以社区管理主体的权利关系为研究对象,以某小区停车位改建工作为例,分析我国城市社区推进公共事务中存在的问题。通过对我国城市社区权利关系的分析,以某小区停车位改建的例子为切入,城市社区中类似于停车位改建的公共事务难以开展,过程中有重重困难,究其原因,是社区管理主体即居民委员会、业主委员会和物业管理公司三者之间权利关系错综复杂,推诿扯皮;而社区居民(业主)缺乏”主人翁”意识,参与社区公共事务的知识与能力都很匮乏。这两重原因导致了社区即便有资金也难以有效率的展开工作,发挥自身的管理职能,真正地推动社区的建设与发展。因此要在理顺居委会、业委会和物业公司三者的关系,充分发挥各自的作用,明确分工,完善社区管理主体的管理服务功能;并且鼓励居民参与到社区公共事务当中去,提高居民的自治意识和能力。保障居民的有序互动和管理主体的高效协同是实现社区善治的根本,希望本文的研究能为城市社区的良性治理提供一定的参考。

Community management and construction
[Abstract] this article takes the community management subject's rights relations as the research object, takes the parking space reconstruction work as an example, analyzes the problems existing in the urban community. Through analysis of China's urban community right relation to a residential parking spaces reconstruction examples as the breakthrough, urban communities in similar to the parking space renovation of public affairs difficult to carry out, the process is difficult, the reason is the complex power relations between the main body of the community management that the residents committee, industry committee and property management companies, shuffle disputes over trifles; and community residents (owners) lack \consciousness, participation in community public affairs knowledge and ability are very scarce. This dual reason led to the community even if there are funds are difficult to work efficiency, to play their own management functions, to promote the construction and development of the community. So in relation to straighten out the neighborhood committees, industry authority and property companies, give full play to their respective roles, clear division of labor, improve the service management function of the community management subject; and to encourage residents to participate in community public affairs, improve the residents of the autonomous consciousness and ability. To ensure the orderly interaction and management of the main body of the effective collaboration is the fundamental to achieve good governance of the community, I hope this study can provide some reference for the healthy management of urban communities.
