Abstract
China has always been making efforts to strengthen the protection of geographical indications, since Trademark law was revised in 2001. General Administration of Quality Supervision, and Ministry of Agriculture of the P.R.C both issued regulations about protecting geographical indications in succession. Then there are three departments who are all responsible of the protection. Internationally, the failure of Doha Round for the agreed recommendation of geographical indications, and there are disputes between European and America, mainly, about whether broad the protection range of geographical indications and whether build up the multilateral register system. All these inconclusive aspects win time for China to make strategies, in order to serve China¡¯s companies better, especially agriculture. On the Bilateral negotiations, themutual recognition of geographical indications between China and European Union makes progress. These projects reduce the trade conflicts, and reinforce the cooperation relations between both sides, which benefit them too. Besides, this one-to-one model is fair for both sides. However, there are also some problems in the efficiency and management.
This article uses standardization research as the main research method, supplemented by comparative analysis and empirical analysis, makes detailed research of the protection for geographical indications, so as to recommend many valuable advices for the polices¡¯ making of China¡¯s geographical indications¡¯ protection.
The situation of multilateral departments¡¯ management easily leads to confusion in management, and bring inconvenience, then, the writer suggests that the protection should belong to one department. Regarding to the controversial issues, the writer believes expanding the protection range is more beneficial for China, but we should adopt a conservation attitude. For the mutual recognition of geographical indications between China and European Union, the writer advices that both sides should increase the communication and cooperation, and reduce the related examination and approval procedures, at the same time, decrease the related standards of equivalence.
Geographical indications are intellectual property rights, and the protection of them is important for companies¡¯ growth and development in modern economy. For the country, this protection can provide advantages for China during the international trade, which make the local companies breaking into foreign markets sooner and better, and in some degree can help China economy¡¯s stable and development.
