摘 要

工程合同是经济合同，是合同管理制度的一个分支，具体指建设单位和勘察、设计和施工材料供应单位，并签订合同的施工工程竣工。项目合同管理是一个复杂而全面的系统工程。它具有宽范围和个体差异的特点。合同管理的成败将影响整个项目的运作和最终目标的顺利实现。虽然目前我国的建设工程合同管理体系日渐规范,管理水平也在不断提高,但与国际先进水平相比还存在一定差距。本文通过对我国建设工程合同管理的现状分析，找出普遍存在的问题，并在工程项目合同管理的关键问题上明确了重点，运用研究和分析方法，完善建筑市场运行机制的健康发展，加强施工合同管理体系的双方建设，制定出具体的解决方案。提出坚持从中国国情出发贯彻项目合同管理理念,建立法制的、政府监督的、自我约束的管理体系,建立公开、公平、公正的投资中介市场,加大投资中介服务的法律责任,为工程咨询和项目管理创造一个更好的市场环境。最后，随着中国建筑业的不断发展,建设项目的合同管理研究将有着广阔的前景和巨大的发展潜力。

Construction contract is one of the economic contracts, refers to the entire contract management system, specifically refers to the construction units and reconnaissance, design, construction materials supply units, complete a certain construction project tasks, signed contracts. Project contract management is a complicated system engineering, comprehensive, has broad, the outstanding characteristic of the individual difference, the success or failure of the contract management, will affect the whole project operation and eventually the smooth realization of the goal. Although current construction project contract management system is standard, management level also constantly improving, but compared with the international advanced level there are certain disparity. This article through to our country the construction project contract management in the field of present condition analysis, find common problems, and to clear the project contract key management, using the method of research and analysis, from the healthy development of the perfect construction market operation mechanism and strengthen the two parties of the contract management system, the construction contract within two aspects, and making out the specific solution. From the China conditions of contract management to carry out the concept of a project, the establishment of legal system, government supervision management system, self-discipline, establish an open, fair and impartial intermediary investment market, increase investment intermediary service legal responsibility, to create a better market environment for engineering consulting and project management. Finally, it is pointed out that with the development of the construction industry, the research work of construction contract management will have broad prospects and great potential for development.

前 言

随着我国的经济体制改革，建筑市场逐步规范和完善。目前，建筑市场激烈的竞争，使企业的利润减少，风险也更大，所以目前建设工程施工合同管理越来越重要，做好合同管理是企业能有效地降低项目风险，维护企业利益和增加企业利润的重要举措。

工程建设过程是一个复杂的社会生产过程，有其自身的规律和特点，具有明显的行业特征。从项目建设的过程中看，可分为项目建议书、项目可行性研究、勘察设计、施工、竣工验收和生产运营各个阶段；从专业技术角度看，项目建设涉及到建筑、结构、给排水、电、燃气、电讯市政、园林绿化等专业设计和施工活动；从所消耗的资源看，需要劳动力、各种建筑材料、施工机械、建筑设备、建设资金等，工业项目更需要专业化的生产设备。因为生产的社会化和专业化,项目通常需要大量的单位参与规划、设计、施工和安装、材料和设备供应和其他工程咨询活动,小型项目可能需要十多个单位,大型项目往往需要几十甚至成百上千的单位。这些单位，从各自的角度和各自的利益，共同通过分工合作完成项目施工任务。在市场经济条件下，合同是维系这些单位和调整各方的权利义务的联系。当然，履行合同期间各种违约行为也会出现，所以就创建了施工合同索赔制度。随着市场经济的不断深化,逐步向国际市场发展,一方面建筑施工企业为了更好地开发外部市场建设,承包商在项目实施过程中如何减少风险,保护自己,并赢得利润应该是特别重要的,而做好工程索赔则是其中一个重要的方面,另一方面,施工单位为了合理控制项目成本,就要防止和避免工程索赔的发生,并做好对承包商的索赔工作。面对当前我国工程项目合同管理存在以及亟需解决的问题，我国应在工程合同管理方面加强应对措施，以保证我国在工程合同管理领域成熟的发展。
